Article 1. Purpose
The purpose of these General Terms of Use (the “Terms of Use”) is to define the conditions of access to and use of the aquagymfit.com website and the AquaGymFit Virtual Coach application (hereinafter the “Service”) published by VSBG.
Article 2. Acceptance of the Terms of Use
Use of the Service implies full and complete acceptance of these Terms of Use. The User acknowledges having read the Terms of Use and undertakes to comply with them.
Article 3. Access to the Service
The Service is accessible 24 hours a day, 7 days a week, except in cases of force majeure or maintenance operations. The publisher reserves the right to temporarily interrupt access to the Service without notice where necessary.
Article 4. Account Creation
Access to the full features of the Service requires the creation of a personal account. The User undertakes to provide accurate information and to update this information in the event of any change.
The User is solely responsible for the confidentiality of their login credentials and for any activity carried out from their account.
Article 5. Use of the Service
The User undertakes to use the Service:
- in accordance with its professional purpose (teaching, training, aquafitness monitoring);
- in compliance with applicable laws and regulations;
- without infringing the rights of third parties or of the publisher;
- without attempting to alter, modify or compromise the security of the Service.
Article 6. Intellectual Property
All elements making up the Service (texts, exercises, libraries, algorithms, interfaces, source code, logos, etc.) are the exclusive property of VSBG or are used under license. Any reproduction is prohibited without prior authorization.
Article 7. Liability
The publisher shall not be held liable for any direct or indirect damage resulting from the use of the Service, except in the event of gross negligence or willful misconduct.
The Service is a tool to assist in creating and running classes. It does not replace the User's training, vigilance and professional expertise, particularly with regard to the safety of participants in the pool.
Article 8. Suspension and Termination
In the event of non-compliance with these Terms of Use, the publisher reserves the right to suspend or terminate the User's account without notice or compensation.
Article 9. Amendments to the Terms of Use
The publisher reserves the right to amend the Terms of Use at any time. Users are informed of amendments by direct notification or via the website. Continued use of the Service after an amendment constitutes acceptance of the new Terms of Use.
