General information<\/h3>\n\n\n\n<p>Welcome to Aqua GymFit! This mobile application (hereinafter referred to as the \u2019Application\u00ab) is dedicated to aquafitness instructors and enables them to design lessons and improve their teaching experience. By downloading, accessing or using the Application, you agree to these General Terms and Conditions of Use (hereinafter \u00bbGTCU\u00ab). Please read them carefully before using the Application. If you do not accept these conditions, please do not use the Application.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. Using the Aqua GymFit application<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">2.1 Creating and managing a user account<\/h4>\n\n\n\n<ul class=\"wp-block-list\"><li>Access to certain Aqua GymFit functions requires the creation of a user account.<\/li><li>You undertake to provide accurate, complete and up-to-date information when registering. You are solely responsible for the confidentiality of your login details and the activities carried out under your account.<\/li><li>In the event of unauthorised use of your account or any breach of security, you must inform Aqua GymFit immediately.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">2.2 Protection of personal data<\/h4>\n\n\n\n<ul class=\"wp-block-list\"><li>Aqua GymFit is committed to respecting your privacy in accordance with current regulations, including the General Data Protection Regulation (GDPR).<\/li><li>The personal data collected is used exclusively to personalise your experience and provide you with the services of the Application.<\/li><li>For more information on the collection, use and protection of your data, please consult our Privacy Policy.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">2.3 User conduct<\/h4>\n\n\n\n<p>You undertake not to use the Application in a manner that is abusive or contrary to the laws and regulations. This includes, but is not limited to, the following behaviours:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Violation of applicable laws, including copyright and intellectual property laws.<\/li><li>Impersonation or misrepresentation.<\/li><li>Sending viruses, malicious software or any content harmful to the Application or users.<\/li><li>Attempting to gain unauthorised access to any account, system or network associated with the Application.<\/li><li>Collection or use of other users' personal data without their explicit consent.<\/li><li>Any action that disrupts or degrades the normal operation of the Application.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">3. Rights and responsibilities<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">3.1 Intellectual property rights<\/h4>\n\n\n\n<ul class=\"wp-block-list\"><li>All content present on the Application, including text, graphics, logos, images, videos and software, is protected by intellectual property rights and belongs to Aqua GymFit or its partners\/licensors.<\/li><li>Any reproduction, modification, distribution or creation of derivative works without the prior written authorisation of Aqua GymFit is strictly prohibited.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">3.2 Limitations of liability<\/h4>\n\n\n\n<ul class=\"wp-block-list\"><li>Aqua GymFit is provided \u00abas is\u00bb. We endeavour to provide a quality service, but we cannot guarantee the accuracy, availability or relevance of the content and functions offered.<\/li><li>Aqua GymFit shall not be liable for any direct or indirect damage resulting from the use or inability to use the Application, including, but not limited to, loss of data, interruptions of service or errors.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">3.3 Suspension or termination<\/h4>\n\n\n\n<ul class=\"wp-block-list\"><li>Aqua GymFit reserves the right to suspend or terminate your access to the Application in the event of non-compliance with these Terms and Conditions or behaviour deemed inappropriate.<\/li><li>Termination of your access does not limit our right to claim compensation for any damage caused.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">4. Modifications and updates to the GTCU<\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li>Aqua GymFit may, at any time, modify or update these General Terms and Conditions. These modifications will be notified to you via the Application or by other appropriate means.<\/li><li>By continuing to use the Application after publication of the changes, you agree to be bound by the new conditions. If you do not accept the changes, you must stop using the Application.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">5. Final provisions<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">5.1 Applicable law<\/h4>\n\n\n\n<p>These GCU are governed and interpreted in accordance with French law.
